Article 1: Acceptance of Terms

These general terms and conditions of sale are agreed upon by SASU ISF TRADING, headquartered at 1-3, ALLEE LAVOISIER 59650 Lille (Siret No: 952909778), hereinafter referred to as “the seller”, and any individual or entity wishing to make a purchase via the website Zenseivaporizers.com, hereinafter referred to as “the buyer”.

The buyer acknowledges having read and accepted these general terms and conditions of sale at the time of placing an order on the Zenseivaporizers.com website. Any order placed implies acceptance of these terms and conditions without reservation. These terms and conditions govern the contractual relationship between Zenseivaporizers.com and its clients, and both parties accept them without reservation. These terms and conditions shall prevail over any other conditions in any other document unless otherwise previously agreed upon in writing by Indian Spirit. Indian Spirit reserves the right to modify these terms and conditions at any time. The applicable conditions will be those in effect at the date of the order by the buyer.

Before confirming acceptance of the offer, the buyer should verify:

  • The details of their order (including product, potential discounts, payment method, delivery method)
  • The total price, including taxes
  • Personal information (name, delivery address, etc.) and correct any errors

To avoid the buyer placing multiple orders in doubt of successful registration, we send an order confirmation via email promptly. This formality assures the buyer that their intention to contract has been duly noted.

Article 2: Products and Pricing

The “product sheets” may include all or some of the following information, depending on the product type offered for sale:

  • Product images
  • Product name
  • Product reference
  • Brief product description
  • Complete product description
  • Usage recommendations, including any prohibitions
  • Technical sheet (packaging, weight, dimensions, brand, etc.)
  • Any associated accessories
  • Any product presentation video

Article 3: Delivery

Products are delivered to the address specified during your order. The delivery address can be different from the billing address. Once the tracking status indicates “distributed” or “delivered” (for deliveries without a signature), no further action can be taken. Zenseivaporizers.com commits to liaising with the carrier as long as this status is not validated (claims, re-shipments, etc.).

SASU ISF TRADING commits to replacing any damaged products upon presentation of a photo of the packaging and clearly identifiable products (a return may also be requested).

For international sales, Zenseivaporizers.com is not responsible for customs blockages in the destination country. No compensation can be claimed from the sender in case of seizure or blockage. However, we will assist you in providing maximum information to try to resolve the situation.

If a package is not received due to recipient-related issues (incomplete delivery address, failure to collect the package from the post office within 15 days, or missing information on the mailbox), the package will only be re-shipped after payment of new shipping fees (same rate as the initial shipment).

Delivery times average 48 hours. In case of delay by the postal service, the buyer cannot claim damages from the seller, nor retain any payment or cancel current orders.

Force majeure events that release the seller from their delivery obligation include war, riots, fire, strikes, accidents, and supply impossibilities. For availability reasons, an order may be delivered in several shipments to the client. The client only pays for one delivery. If the client wishes to have two delivery locations, they must place two orders with the corresponding shipping costs.

Article 4: Right of Withdrawal

Under Article L121-20, you have fourteen days to exercise your right of withdrawal without having to justify reasons or pay penalties, except for return shipping costs.

The product must never have been used and must be returned in its original, intact packaging. Please include your original invoice with returns. No return shipping costs will be reimbursed, and no cash-on-delivery returns will be accepted.

Article 5: Warranty

All products supplied by the seller are covered by the legal warranty provided by Articles 1641 and following of the Civil Code. In case of non-conformity of a sold product, it can be returned to the seller, who will take it back, exchange it, or refund it (depending on available stock). All claims, exchange requests, or refunds must be made via the contact form on the website. Returns are at the client’s expense.

According to Article L. 221-18 of the Consumer Code, the CLIENT has fourteen (14) calendar days from the date of the order to exercise their right of withdrawal.

The period starts the day after the CLIENT receives the order, at the first hour. The day of receipt is not counted. The period expires at the last hour of the last day. If this period ends on a Saturday, Sunday, public holiday, or non-working day, it is extended to the next working day.

No withdrawal requests will be processed by the SELLER after this period.

The warranties do not cover defects and their consequences due to:

  • Intervention by a repairer not authorized by Indian Spirit
  • Failure to follow usage and maintenance instructions
  • Any handling errors and lack of maintenance of the products
  • Use not conforming to the intended use of the product
  • Malfunction from an atomizer or charger (car or USB charger) not supplied by Indian Spirit

Article 6: Liability

The buyer is expressly informed that Zensei is not the manufacturer of the products. Consequently, in case of damage caused to a person or property by a product defect, only the manufacturer’s liability can be pursued by the buyer. The seller, in the online sales process, is only bound by an obligation of means; their liability cannot be engaged for damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruptions, or other unintentional issues.

All products sold by Zenseivaporizers.com are intended for simulating smoke inhalation. Some products used for vaporization contain Propylene Glycol or Vegetable Glycerin. No scientific studies have been conducted on the potential side effects of these substances, and the client acknowledges using these products at their own risk.

Article 7: Intellectual Property

All elements of the Zenseivaporizers.com website remain the intellectual and exclusive property of SASU ISF TRADING. No one is authorized to reproduce, exploit, redistribute, or use any part of the site, be it software, visual, or audio, without express permission from the owner. Photos on the site are non-contractual.

Article 8: Personal Data

According to the Data Protection Act of January 6, 1978, personal information about buyers may be subject to automated processing. Zenseivaporizers.com reserves the right to collect information about buyers, including using cookies, and, if desired, to share collected information with commercial partners.

Buyers can oppose the disclosure of their contact details by notifying Zenseivaporizers.com. Similarly, users have the right to access and rectify data concerning them, according to the law of January 6, 1978.

The automated processing of information, including the management of users’ email addresses, has been declared to the CNIL (No. 1560311).

Article 9: Disputes

In any case, product use is under the client’s sole responsibility. The client is responsible for maintaining the product, keeping it in good condition, and using it as intended, following applicable provisions and usage recommendations provided by Indian Spirit or its suppliers. Clients are advised against modifying the product, opening and altering electronic components, or installing non-compliant accessories or parts. Indian Spirit cannot be held responsible for defects and deterioration of products due to abnormal or non-compliant use post-delivery.

Generally, and subject to court discretion, adherence to these terms assumes:

  • The buyer fulfills their financial obligations to the seller
  • The buyer uses the products normally

Claims or disputes will always be received with attentive goodwill, assuming good faith in those presenting their cases. In case of dispute, the client should first seek an amicable solution with the company.

Failing this, disputes will be brought before the competent courts.
